W 2022 r. Specjalny Sprawozdawca ONZ ds. praw człowieka i migracji odbył wizytę w Polsce. Z wizyty powstał raport, który był omawiany na sesji Rady Praw Człowieka 26 czerwca 2023 r.
W swoim stanowisku na temat raportu FEDERA odniosła się do fragmentu dotyczącego konsekwencji restrykcyjnego prawa aborcyjnego dla uchodźczyń oraz rekomendacji do rządu polskiego w tym zakresie. FEDERA zamieściła swój apel o zapewnienie kobietom, w tym w znajdujących się detencji, podstawowej opieki zdrowotnej w zakresie zdrowia seksualnego i reprodukcyjnego.
W raporcie Specjalnego Sprawozdawcy zwróciłyśmy uwagę na dyskryminację w traktowaniu uchodźczyń z Ukrainy w porównaniu z migrantkami z granicy pomiędzy Polską a Białorusią. Te drugie doświadczają często push-backu bez uzyskania dostępu do podstawowej opieki zdrowotnej lub są pozbawiane wolności w zamkniętych ośrodkach detencyjnych. Dotyczy to kobiet w ciąży, dzieci i osób z zaburzeniami psychicznymi. Taka praktyka jest nielegalna i stanowi ryzyko dla ich życia i zdrowia, co jest sprzeczne z międzynarodowymi standardami praw człowieka.

I make this statement on behalf of the Federation for Women and Family Planning from Poland.
We welcome the report of the SR on the human rights of migrants following his visit to Poland and Belarus and the considerations given to their lack of access to health services.
The report shows clearly the discrimination Polish authorities make in treatment of the refugees from Ukraine and the migrants at the border between Poland and Belarus. This second group of most vulnerable migrants is often pushed back without access to essential health care or they get deprived of liberty in closed detention facilities. This includes pregnant women, children and persons with mental health conditions. Such practice is illegal and places their life and health at risk in contravention of international human rights standards.
FEDERATION welcomes the attention given by the SR to the consequences of the restrictive abortion law and the recommendation to address the obstacles faced by refugee women to legal abortion. We add to this our call on the Polish authorities to provide women including in detention with essential sexual and reproductive healthcare. These obligations derive from the rights to life, to freedom from torture and other ill-treatment, to privacy and to the highest attainable standard of health.
